Hunter Biden's attorneys suggest he was drinking but not abusing drugs at time of gun purchase

WILMINGTON, Del. — Defense attorneys for Hunter Biden tried to cast doubt in his trial Wednesday about whether he was using drugs when he purchased a revolver in 2018, as federal prosecutors have alleged.

On cross-examination, defense attorney Abbe Lowell pressed FBI Special Agent Erika Jensen about a series of bank statements that chronicled Hunter Biden’s alcohol purchases in the days leading up to the gun purchase in October 2018. Mr. Lowell suggested that Hunter was consuming alcohol at the time, but not illegal drugs.

The president’s son is charged with lying on a gun form by checking a box that was not using illegal substances at the time of the purchase. He has previously admitted to an addiction to crack cocaine.



Mr. Lowell asked Ms. Jensen about text messages that prosecutors say show evidence of Hunter Biden’s drug use in 2018 and 2019. But the defense lawyer cited a text in November 2018 in which Hunter Biden wrote, “I’m a drunk.”

A Wells Fargo statement from Hunter Biden’s business account from November 2018 shows a total withdrawal of $3.4 million. 

“You’re not suggesting that all that money was used to buy drugs,” Mr. Lowell asked Ms. Jensen.

“No,” she responded. 

Ms. Jensen also said she doesn’t know how much of the money was used towards alimony, financially supporting his daughters or other family members. She also couldn’t say if any of the cash was used to purchase the gun. 

Towards the end of his questioning, Mr. Lowell also tried to undermine the credibility of a laptop Hunter Biden left at a Delaware computer repair shop and the FBI agent’s ability to authenticate it.

“Did you find out if any of the files had been tampered with?” he asked.

“I did not,” Ms. Jensen replied, acknowledging that the FBI didn’t obtain the laptop until 2019, six months after it was left at the repair shop.

Prosecutors quickly objected when Mr. Lowell began asking about the laptop, and he moved on to other questions. 

The trial entered its second day of testimony Wednesday in federal court. Prosecutors said Hunter Biden’s own words from his autobiography prove he was abusing drugs when he filled out a federal firearms application in October 2018 claiming he was not an “unlawful user” of controlled substances. He faces three felony charges of lying on a gun form.
