The hush money prosecution of Trump is a flagrant partisan assault on democracy

When special counsel Robert Hur announced he wouldn’t bring charges against President Joe Biden for his improper handling of documents, he set off a torrent of anger among Biden’s supporters — because he did it in a way that made Biden look bad.

This isn’t an unfair criticism of Hur, but it applies 1,000 times over to the political prosecution of former President Donald Trump in New York.

The theory of the New York case against Trump was totally unproven and incredibly thin, but it did succeed in dragging into the light unflattering facts about Trump that highlight how unfit he is for the presidency.

The liberals commenting on the case knew that, and that’s how they used the case. Here’s David Corn:

Trump’s defense team is correct, and so is Corn. Michael Cohen is literally a professional liar, so basing your prosecution on his testimony is laughable — but hiring him as your fixer and confidant is also damning.

And, of course, the underlying facts of the case demonstrate Trump’s dishonesty and low character — which ought to count against him as he seeks another term in the White House.

The case against Trump is originally based on the idea that his hush money payment should have been classified as a campaign contribution. The less far-reaching claim is that the accounting entry, by someone besides Trump, was knowingly false. That either of these offenses adds up to a felony is quite the stretch.

And here’s the problem: The first-ever criminal prosecution of a major-party nominee for president and of a former president ought to be based on more sound legal theory than this thin web woven of dubious strings.

Exposing Trump’s shady connections, narcissism, and immorality are all fitting acts for the news media and the Biden campaign, but they are an abuse of power for a prosecutor.

Using the prosecutorial power for strictly political means is banana republic stuff. This case may go down in history as a dark turning point in our republic.
