CNN senior legal analyst Elie Honig on Monday noted that star prosecutor’s witness in DA Alvin Bragg’s case against Trump, Michael Cohen, is guilty of a "more serious of a crime" than those Trump is alleged to have committed.

"Michael Cohen explained this whole thing: 'that's what was owed and I didn't feel Mr. Trump deserved the difference.' That's a lot different than 'I stole $60,000 from my boss on the transaction at the heart of this case,' and by the way, the fact that he was never charged with larceny is important because stealing $60,000 through fraud, which will be larceny in New York State is more serious of a crime than falsifying business records," said Honig.

Cohen on Monday admitted to stealing from the Trump Organization, and that he was never charged for it.

"You stole from the Trump Organization?" Trump lawyer Todd Blanche asked, to which Cohen replied, "Yes."

When asked if he was prosecuted for larceny or made to pay it back, Cohen said he was not.

Cohen testified that he paid around $20,000 of the $50,000 the Trump Organization owed to tech company Red Finch in cash, bringing it in a brown paper bag, and pocketing the rest of it. The $30,000 Cohen took was "grossed up" for "tax purposes," bringing the total to $60,000, according to The Hill.

"You lied to (Allen) Weisselberg about how much you needed for Red Finch?" Blanche asked. Cohen said this was correct.

Honig said that prosecutors "have to undo some damage" to Cohen’s credibility after the witness was cross-examined in the morning, adding that they "have to get the jury to focus back on the indictment, back on the charges." The prosecution rested their case on Monday afternoon.

"They can't change the fact that Michael Cohen stole money from the Trump Organization on the key transaction. They can't change the fact that there are texts that undermine a key portion of Michael Cohen's testimony" about an October phone call where Cohen had previously claimed to have spoken with Trump about the alleged Stormy Daniels payment.
