Report: Bragg Won’t Oppose Request to Delay Trump Sentencing

Manhattan District Attorney Alvin Bragg has filed a motion indicating that he will not oppose a request from attorneys representing former President Donald Trump to delay sentencing in his hush-money case, though some suspect his decision could be politically motivated.

In a filing submitted ahead of the weekend, the left-wing prosecutor announced that his office would not oppose Trump’s attorneys’ motion to delay the scheduled sentencing hearing on September 18th, the Washington Examiner reported.

The filing follows a landmark U.S. Supreme Court ruling granting presidents absolute immunity from official acts performed in office, which Trump’s legal team claimed include the hush money payments to adult film star Stormy Daniels.

In June, Trump was convicted of 34 felony charges for orchestrating the payments to aid his 2016 presidential campaign and for misclassifying the payments in business records. Bragg’s prosecutors said in their filing with Judge Juan Merchan that their office will not offer a sentencing recommendation, which could include jail time.

“The People defer to the Court on the appropriate post-trial schedule that allows for adequate time to adjudicate defendant’s [presidential immunity] motion while also pronouncing sentence ‘without unreasonable delay,’” prosecutors wrote, according to the Examiner.

“The Supreme Court’s recent decision did not consider whether a trial court’s ruling on that distinct evidentiary question is immediately appealable, and there are strong reasons why it should not be. Nonetheless, given the defense’s newly-stated position, we defer to the Court on whether an adjournment is warranted to allow for orderly appellate litigation of that question, or to reduce the risk of a disruptive stay from an appellate court pending consideration of that question,” the filing — the second in as many months from Bragg in not opposing a sentencing delay — added.

RedState contributor Bonchie labeled the letter from Bragg’s office as an “incredibly transparent” attempt to keep Trump out of jail while aiming to avoid increasing public sympathy for the Republican nominee, who narrowly escaped an assassination attempt just a month ago. “This is Bragg trying to protect Democrats from any possible backlash,” he added.

Since then, President Joe Biden has ended his reelection campaign, clearing the path for Vice President Kamala Harris to be officially nominated by the Democratic Party at this week’s national convention in Chicago. Most mainstream polls now show Harris in a dead heat with Trump, a significant improvement from Biden’s declining numbers in recent weeks.

“Shark Tank” star investor and O’Leary Ventures Chair Kevin O’Leary sounded the alarm over the potential damage the U.S. economy will suffer thanks to Democrat-led efforts to convict and potentially jail Trump.

In an interview with “Fox & Friends” in June, O’Leary explained how he believes Trump’s historic felony trial in Manhattan will impact the economy.

“I would ask everybody, regardless of your politics, to think about the big picture and what America means to the rest of the world. It’s the largest economy on Earth. It has the best legal system, including the appellate system, which now Trump will go through. And if there’s something wrong with his trial, it wasn’t done properly, the appellate system will catch it. That’s what people believe about the American legal system,” O’Leary began.

He went on to say that “belittling” a former president in the face of justice could have a devastating impact on the “American brand.”
