Officials in a heavily Democratic county in a blue state released an illegal alien who had been convicted of rape, despite Immigration and Customs Enforcement (ICE) formally requesting that he be handed over for deportation.
As the Daily Caller reports, 19-year-old Henry Argueta-Tobar is a Guatemalan national who had been living in Charles County, Maryland illegally. ICE successfully arrested him on Wednesday in Waldorf, Maryland, after Charles County officials refused to cooperate, after suspending his 20-year prison sentence and releasing him.
“After unlawfully entering our country, Henry Argueta-Tobar made his way to Maryland and victimized one of our residents,” said ERO Baltimore acting Deputy Field Office Director Vernon Liggins. “We could not allow him to continue to threaten our communities. ERO Baltimore will continue to prioritize public safety by relentlessly pursuing unlawfully present sexual predators and egregious criminal noncitizens.”
Tobar was first apprehended by Border Patrol in May of 2019, when he illegally entered the United States near El Paso, Texas. The Border Patrol then turned him over to ICE, where he was ultimately released on an order of recognizance due to being a minor at the time.
On December 22nd, the Charles County Sheriff’s Office charged Tobar with second degree rape and arrested him. Following this announcement, ICE filed a detainer request, instructing local authorities to inform ICE when he was released from their custody so that ICE could apprehend him. But the Charles County Detention Center ignored the request and deliberately did not inform ICE of his release.
Tobar was ultimately convicted and initially sentenced to 20 years in prison by the Circuit Court for Charles County. But then the court suspended his sentence, reducing it to just 190 days in prison. He still had to register as a “tier 3” sex offender in the state of Maryland, meaning that he will remain on the sex offender registry in the state for the rest of his life. He was released from local custody on July 3rd.
Tobar remains in ICE custody following his most recent apprehension, where he may face deportation.
