Convicted sex offender charged with rape after luring 13-year-old girl to his tent in Seattle homeless encampment

A homeless sex offender who had a warrant out for his arrest is now facing charges of luring a 13-year-old girl into his tent near a Seattle park and raping her.

According to charging documents obtained by The Ari Hoffman Show on Talk Radio 570 KVI, on June 26, Brian David Miller (51) approached a 13-year-old girl who was sitting on a bench near a playground in Seattle’s Wallingford neighborhood. The girl had left her home after an argument with her mother.

Miller allegedly struck up a conversation with the girl and when it began to rain took her took her to a nearby restaurant where he bought her a milkshake. He then told the victim he would give her a cell phone because her parents would not allow her to have one, but it was in his tent.

According to police, Miller took the girl to his encampment in Woodland Park near a local zoo which was "hidden" in the trees and smoked marijuana with her. Charging documents state that when the girl was in the tent, Miller hit her in the head and raped her when she tried to leave.

After the girl returned home, her parents discovered what happened when they found out she had a cell phone they had not provided her. It had allegedly been given to her by Miller so they could meet up in the future. The parents contacted the police and officers showed the family Miller’s picture from the King County sex offender registry. The girl confirmed his identity. Staff at Seattle children’s hospital found bruising on the girl during an examination following the incident.

Surveillance video from the restaurant where Miller bought the milkshakes shows him with the victim before the alleged assaulted. When Miller was arrested he appeared to be wearing the same clothing from the footage.

The King County Prosecuting Attorney’s Office charged Miller with one count of rape of a child in the second degree, and one count of luring. He is being held on a bail $750,000 in the King County Jail and on Thursday pleaded not guilty to the charges.

Miller is listed on the King County Sex Offender Registry as an absconded sex offender after he was released from prison in April following a four-year sentence for a conviction of attempted commercial sex abuse of a minor. He also has a pending case for failing to register as a sex offender.

In 2020, Miller was arrested following a sting of an online child predator. According to court documents he was communicating with an undercover police officer who was pretending to be a 15-year-old girl and attempted to arrange sexual acts with the girl and promised to help her earn $9,000 a week doing "physical things."
