It's been nine years since David Daleiden exposed illegal activity in the abortion industry in the sale of fetal tissue from abortions. It's also been nine years since then-Attorney General Kamala Harris declared war on Daleiden in an attempt to bury his undercover videos. Harris and her California prosecutors conducted a broad and pernicious campaign of lawfare against Daleiden and his colleagues at the Center for Medical Progress for using the same kind of undercover-journalism techniques used by the mainstream media for decades.

It took nine years -- nine years -- for a court to recognize that the state cannot suppress the videos. The New York Post reports on the publication of two videos from Daleiden that allegedly shows Planned Parenthood officials discussing how to dismember fetuses during their abortions to avoid violations of the Partial Birth Abortion Act (PBA):

A pro-life activist investigated for criminal activity by then-California Attorney General Kamala Harris in 2015 released undercover footage Tuesday showing Planned Parenthood executives apparently discussing the sale of body parts from late-term fetuses, some of which had been delivered alive and mostly intact.

David Daleiden of the Center for Medical Progress (CMP), who posed with a colleague as laboratory wholesalers at the National Abortion Federation’s commercial trade show in 2015, videotaped two conversations with Dr. Ann Schutt-Ainé, the chief medical officer of Planned Parenthood Gulf Coast, and Tram Nguyen, RN, the branch’s vice president of abortion access.

While the CMP has always contended that Daleiden’s videos revealed illegalities, Planned Parenthood said at the time the initial videos were released that their staffers were discussing legal, not-for-profit donation of fetal tissue to research firms.

But Daleiden claims these newly released videos show even more demonstratively that Planned Parenthood’s talking points at the time were false — and that staff was engaged in wrongdoing.

CMP has much more in its press release this morning, including the appearance of coordination between Harris and Planned Parenthood in suppressing the tapes. Even while Congress subpoenaed the videos for a probe into fetal-tissue sales and potential abuses and crimes, Harris raided Daleiden's home, seized the data, and didn't release it:

In 2015, the National Abortion Federation, stating it was representing institutional member Planned Parenthood, sought and received a federal injunction against the release of the footage in San Francisco federal court. Nguyen, Dr. Schutt-Aine, and Santos have all served as Board Directors of NAF. At the same time, Planned Parenthood requested then-California Attorney General Kamala Harris’ office to seize from Daleiden the digital media containing the videos. Two weeks after a March 2016 meeting with top Planned Parenthood California officials implicated in the videos, AG Harris’ office conducted the raid on Daleiden’s home.

However, Congress had also subpoenaed the footage from CMP in late 2015. In May of this year, the San Francisco District Court finally ruled that CMP cannot be prevented from republishing any of the subpoenaed footage released by Congress.

The timing turned out to be ironic, no? Had the state of California stayed out of this, the issue would likely have dissipated sooner rather than later. The videos would have gotten published, and perhaps would have resulted in some financial consequences for Planned Parenthood in the short run. But they would have been old news by now, and would have had no real connection to the Democrats' anointed nominee for president in 2024.

Instead, the end of the nine-year fight over the videos just happens to coincide with The Anointment, and they're news all over again. Of course, Harris might not have gotten elected to the Senate in 2016 without having coordinated the lawfare against Daleiden, either.

What about the videos themselves? They're horrific, and carry a NSFW warning from CMP based on the content of the conversations. The first video shows a conversation between their undercover reporter, Dr. Ann Schutt-Aine, the Chief Medical Officer of Planned Parenthood Gulf Coast, and Tram Nguyen, RN, the branch’s Vice President of Abortion Access. That conversation relates more to the legal problems of Planned Parenthood's tissue sales:

In the first conversation, the undercover reporter, from The Center for Medical Progress, tells Nguyen and Dr. Schutt-Aine, “Liver is in short demand,” describing competition for fetal organs and cells based on what is “more profitable” for suppliers. Dr. Schutt-Aine responds, telling Nguyen: “[Y]ou told me about the proposition, and so now every time a do a D&E [dilation and evacuation abortion], I’m like, ‘Oh there’s some lungs, there’s some kidneys.’”

Nguyen then apologizes for a highly dismembered fetus she showed CMP undercover reporters during a site visit to the clinic a few weeks prior, saying other days the aborted fetuses may be delivered with only one limb missing: “We just had to hurry up, whereas other days it’s more intact, where it’s like maybe only like an arm that’s disarticulated.”

Nguyen remarks later, “I’m like, ‘Yeah, I have like a leg for you!’ I’m like, oh sh**, if other people were to hear me, they’d be like, you are f***ing evil.”

The second conversation may be even more legally problematic for Planned Parenthood's execs. They discuss how they "disarticulate" fetuses during the procedure for the explicit purpose of not having to comply with the PBA:

“A lot of it has to do with dilation” of the mother’s cervix, the opening to the uterus, Dr. Schutt-Aine explains: “Because when you have good dilation, a cervix that’s either well-dilated and/or just softer and more pliable, then as you bring the fetus down, you can get more of it out before disarticulation occurs.”

Dr. Schutt-Aine states it may typically take 3 or 4 “passes” of the forceps into the mother’s body to remove the fetus. Nguyen then volunteers: “There are some that are like, I need you to make one more pass, one more pass,” to which Dr. Schutt-Aine clarifies, “To avoid PBA,” the acronym for the federal Partial-Birth Abortion law. Nguyen exclaims, “Yeah, I was like, ‘Uh, getting a little bit too close!’”

Dr. Schutt-Aine then explains further: “If I’m doing a procedure, and I’m seeing that I’m in fear that it’s about to come to the umbilicus [navel], I might ask for a second set of forceps to hold the body at the cervix and pull off a leg or two, so it’s not PBA.”

Yeah, I'd call that "f***ing evil," and it's clear that they knew it at the time, too. So did Kamala Harris, which is why she worked so hard to bury this reporting and punish the people who exposed the evil. 

The cover-up did one thing, though. It made sure that these Planned Parenthood officials can't be prosecuted for any crimes, since the statutes of limitation will almost certainly make it impossible for Texas or federal prosecutors to investigate. For that, Planned Parenthood still owes Kamala Harris and her use of state prosecutorial power to help cover up their potential crimes and admissions.
