Harris faces legal fight for Biden’s war chest

Vice President Kamala Harris suddenly found herself as the likely Democrat Presidential candidate after President Joe Biden’s sudden and surprising decision to exit the race.

Modern Presidential campaigns have become billion-dollar operations that are akin to overseeing a Fortune 500 company.

Harris suddenly had to build a campaign from scratch.

Democrats assumed that she would be able to inherit the money that Biden had raised for his re-election campaign since she was his announced running mate.

But neither Biden nor Harris had actually accepted their Party’s nomination prior to the shakeup, putting Democrats’ efforts to give Harris the campaign cash in legal jeopardy.

Now, Harris faces a legal challenge to keep her from receiving the nearly $100 million campaign war chest that Biden had accumulated.

Former President Donald Trump’s campaign filed a complaint with the Federal Election Commission (FEC) that argues that Harris isn’t entitled to Biden’s campaign money.

“This is little more than a thinly veiled $91.5 million excessive contribution from one presidential candidate to another, that is, from Joe Biden’s old campaign to Kamala Harris’s new campaign,” Trump general counsel David Warrington wrote in the complaint. “Contributions by federal candidate committees to other federal candidates are limited to $2,000.”

Kamala Harris is accused of breaking federal campaign finance law

Warrington accused Harris of being involved in the biggest violation of campaign finance law in history.

“Kamala Harris is in the process of committing the largest campaign finance violation in American history and she is using the Commission’s own forms to do it,” the complaint added.

The complaint alleges that Harris – as a new Presidential candidate – needed to create a new campaign committee with a statement of candidacy.

Harris instead simply changed the name of Biden’s statement of candidacy to her own and used the same ID as the Biden campaign committee, thereby allowing her to assume control of the money.

“There is no provision in federal campaign finance law for Kamala Harris to take over Joe Biden’s candidacy now by quite literally attempting to become him via an amendment… and making off with all of his cash,” Trump’s legal team argued. “Ms. Harris’ actions constitute a massive excessive contribution from Biden for President to Ms. Harris.”

Typically, under federal campaign finance law, there can only be one candidate associated with a campaign committee.

“If the Commission were to deem Joe Biden to have ended his candidacy before transferring his campaign funds to Kamala Harris, then this only creates another violation,” the complaint continues. “Federal candidates are prohibited from keeping contributions for elections in which they do not participate.”

Federal Election Commission Chairman Sean Cooksey predicted that the “complicated” situation would result in a legal fight – one that will take months, if not longer, to reach a resolution.

Replacing a Presidential candidate this late in the campaign is proving to be more complicated than Democrats ever imagined.
