Supreme Court Rules Virginia May Purge 1,600 Noncitizens From Voter Rolls

In a 6-3 decision Wednesday, the Supreme Court blocked the Biden-Harris regime’s efforts to facilitate voter fraud in Virginia, allowing the state to purge roughly 1,600 non-citizens from its voter rolls.

Last week, a Biden-appointed federal judge granted an injunction request brought against Virginia election officials by the Biden Justice Department, and ordered the state to reinstate the self-identified noncitizen voter registrations.

The Biden Justice Department argued the National Voter Registration Act (NVRA) restricted states from making systemic large-scale changes to their voter rolls 90-days before an election.  Virginia’s voter removal program was launched in August, exactly 90 days before Election Day.

The NVRA has exceptions for removals within 90-day period before an election, George Washington University Law Professor Jonathan Turley pointed out last week, “including the removal of individuals who are ‘ineligible to vote because of a criminal conviction or mental incapacity, or for ‘correction of registration records pursuant to this chapter.’”

U.S. District Judge Patricia Giles granted the Biden-Harris Justice Department’s request for a preliminary injunction on Friday.

Virginia officials immediately petitioned the Supreme Court to grant a request for emergency relief, arguing that Giles’ order violates Virginia law “and common sense,” and “mandates a variety of disruptive measures.”

The lower court’s injunction would “impose significant cost, confusion, and hardship upon Virginia, creating a massive influx of work for its registrars in the critical week before the election, and likely confusing noncitizens into believing that they are eligible to vote,” state officials wrote.

The court’s six conservative justices supported the stay, and the three liberals—Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson—dissented.

Virginia Governor Glenn Youngkin (R) said in a statement Wednesday that he was “pleased by the Supreme Court’s order.”

“This is a victory for commonsense and election fairness. I am grateful for the work of Attorney General Jason Miyares on this critical fight to protect the fundamental rights of U.S. citizens,” Youngkin wrote.

“Clean voter rolls are one important part of a comprehensive approach we are taking to ensure the fairness of our elections. Virginians also know that we have paper ballots, counting machines not connected to the internet, a strong chain of custody process, signature verification, monitored and secured drop boxes, and a ‘triple check’ vote counting process to tabulate results. Virginians can cast their ballots on Election Day knowing that Virginia’s elections are fair, secure, and free from politically-motivated interference.”
