Philadelphia DA sues Musk, super PAC over $1 million giveaway for swing-state voters

The Philadelphia district attorney is suing Trump ally Elon Musk and his super political action committee, America PAC, over the $1 million giveaways to registered voters in swing states.

“The Philadelphia District Attorney is charged with protecting the public from public nuisances and unfair trade practices, including illegal lotteries. The DA is also charged with protecting the public from interference with the integrity of elections,” DA Larry Krasner said in a statement Monday.

Mr. Musk, Tesla CEO and X owner, pledged to give away $1 million a day to voters who sign his political action committee’s petition supporting the Constitution earlier this month. Mr. Musk said he would give out the money until Election Day, Nov. 5.

The tech billionaire started his America PAC in May, with a focus on voter turnout in battleground states. 

There have been four winners so far from Pennsylvania. Five other checks have been given out in North Carolina, Michigan, Wisconsin and Arizona.

The website says the money giveaway is open to voters in the key battleground states of Pennsylvania, Georgia, Nevada, Arizona, Michigan, Wisconsin and North Carolina.

“Our goal is to get 1 million registered voters in swing states to sign in support of the Constitution, especially freedom of speech and the right to bear arms,” the website says. “This program is exclusively open to registered voters in Pennsylvania, Georgia, Nevada, Arizona, Michigan, Wisconsin and North Carolina.”

The website also notes a special offer for registered voters in the Keystone State, which includes $100 for signing the petition and $100 to refer someone else to sign.

Some have called into question the legality of Mr. Musk’s offer. The Justice Department sent a letter to the super PAC warning that the sweepstakes could violate federal laws. President Biden told reporters Monday after casting his ballot in Delaware that the giveaways are “totally inappropriate.”

Trump legal surrogate David Gelman slammed the Philadelphia DA as corrupt in a statement Monday.

“This is par for the course for the corrupt DA of Philadelphia. DA Krasner has been the weakest DA the city of Philadelphia has ever had,” Crime is higher under his leadership than it has ever been,” said Mr. Gelman, a former prosecutor turned criminal defense attorney. “This is a last ditch effort that I guarantee was in coordination with the Harris campaign. There is no legal theory or reason the DA has a leg to stand on. This is nothing more than a political stunt.”
