A judge blocked an Iowa immigration law that would allow police to file charges against people facing deportation, declaring it unconstitutional.
The law, which was set to take effect on July 1, was challenged by the Department of Justice, which declared it unconstitutional. In a Monday ruling, U.S. District Judge Stephen Locher sided with the DOJ.
“As a matter of politics, the new legislation might be defensible,” he wrote. “As a matter of constitutional law, it is not.”
Gov. Kim Reynolds (R-IA) expressed her disappointment over the decision.
“Iowa’s legislation to deter illegal immigration has been BLOCKED – leaving us defenseless to the consequences of Biden’s Open Border,” Reynolds said in a post on X. “More crime, overdose deaths, and human trafficking. All because Biden won’t do his job!”
She elaborated in another statement obtained by the New York Times.
“Plainly, the Biden administration is failing to do their job and enforce federal immigration laws allowing millions to enter and re-enter without any consequence or delay,” she said. “I signed this bill into law to protect Iowans and our communities from the results of this border crisis: rising crime, overdose deaths and human trafficking.”
Iowa Attorney General Brenna Bird expressed similar sentiments.
“I am disappointed in today’s court decision that blocks Iowa from stopping illegal reentry and keeping our communities safe,” Bird, a Republican, said in a statement. “Since Biden refuses to secure our borders, he has left states with no choice but to do the job for him.”
Bird also said she would appeal the decision.

The law in question, passed as Senate File 2340, was highly popular in the state legislature, passing with a 34-16 vote in the Senate and 64-30 in the House. It was modeled after a law passed in Texas. The law would make it a state crime for a person to be in Iowa if they were denied entry into the country or are an illegal immigrant who has previously been deported.
The Biden administration has argued against state immigration laws, arguing they are unconstitutional.
