Democratic Mayor Sues To Force Removal Of New York Business’s Pro-Trump Sign

From small yard signs to giant billboards, there are campaign messages of all sorts on display in communities across the United States.

But for the owner of one company, a prominent sign in support of President Donald Trump resulted in an ongoing showdown with local Democratic leaders.

According to UPI:

The company Sticker Mule is facing a lawsuit filed in a New York court over a pro-Trump sign it installed on the roof of a building that local officials warn could pose dangers to the safety of residents.

The city of Amsterdam, located northwest of Albany, filed the suit against Sticker Mule on Thursday in the state Supreme Court in Montgomery County, court documents obtained by UPI show.

Grant Egelston, a code enforcement officer, charged that the 100-foot-wide sign constructed on the roof of 26 Elk Street violates city laws by presenting a “dangerous distraction” that “impacts traffic flow” on local roadways.

The city also argued that the sign violates a city code where a sign atop a business must relate to the business underneath, and Donald Trump has no affiliation with the company.

The lawsuit has been interpreted by some critics as an effort to impede business owner Anthony Constantino’s First Amendment rights:

Here’s how the company responded to the latest conflict, according to Fox News:

“The affidavit claims, without evidence, that the city will suffer irreparable harm because the sign is a dangerous distraction for drivers due to its novelty and the fear that people will stop to take pictures of it,” said Sal Ferlazzo, general counsel for Sticker Mule. “The court, based solely on the city’s presentation and without any opportunity for me to respond, did initially grant a preliminary injunction and restraining order.”

A hearing is scheduled for Oct. 8 at 10 a.m. Until that time, the court ordered Sticker Mule to refrain from “displaying any sign and/or illumination of any sign on the roof of 26 Elk Street.”

On the advice of legal counsel, Sticker Mule has temporarily covered up the pro-Trump sign to comply with the court order.
