Oregon’s judicial jailbreak comes as no surprise, considering the track record of its blue leadership. But now that the Ninth Circuit Court has weighed in on their lack of following the Constitution, the state could experience a huge inmate problem. All because the state has failed to provide attorneys for its indigent inmates.

The Sixth Amendment “nightmare”:

“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.” Cornell Legal Information Institute

There are currently 3,200 Oregon inmates that have no public defender; 146 of them are in custody. The appeals court ruled that all inmates that were not provided an attorney must be released.

“In March, a draft report from the Office of Public Defense Services found that Oregon needs 500 more attorneys to meet its obligations, according to OPB. State officials have attempted to address the issue, as well as providing additional funding, but structural issues still persist. 

Some changes are currently in progress, including hiring the first trial-level public defenders who are also state employees. And next year, the Oregon Public Defense Commission will move from the judiciary to the executive branch under the governor, a move state lawmakers hope will give the agency more support.

The 9th Circuit’s decision upheld a preliminary injunction issued last year by U.S. District Court Judge Michael McShane after 10 people in Washington County who were charged with crimes and held at the county jail while not having court-appointed attorneys filed a class action habeas corpus petition through the state’s federal public defender’s office.” Fox

The “Judicial Jailbreak”

Will this presidential election be the most important in American history?

Judge Patrick Bumatay wrote a dissenting opinion that stated this ruling was tantamount to a ‘judicial jailbreak.’  The hard fact is, the State of Oregon is ultimately responsible for this disaster, not this court ruling. Make no mistake it is a disaster both for Oregon communities and the US Constitution (lot of that going around these days).

Plus, is it wise for the state to move the Public Defenders to the executive branch? That places them directly under the purview of the liberal Governor.

“And those being released are not sitting there for some petty offense. Just look at the charges of the named Petitioners here—they are accused of rape, kidnapping, strangulation, assaulting a police officer, public indecency, and burglary. All will now be released into Oregon’s communities.” Judge Patrick Bumatay

This ruling may be appealed after review.
