TikTok Ban Bill Goes to Trial

The social media company TikTok has begun making its case in court against a federal law that will either force TikTok’s parent company to sell it, or else see the app be banned from use in the United States.

As reported by Axios, the law in question was passed by Congress with bipartisan support and was signed into law by Joe Biden. The law orders ByteDance, TikTok’s parent company, to either sell the app to an American company by January, or else the app will be banned from app stores and devices within the United States.

The law was primarily passed due to ongoing concerns over ByteDance’s connections to the Chinese Communist Party (CCP), as ByteDance is a Chinese company. TikTok, which originally got its start as a platform for people to share short videos lip-syncing famous songs, has since become a hotbed of foreign propaganda, particularly with regards to the upcoming presidential election as well as the ongoing war in Israel.

Democrats have expressed concerns over user privacy on the app being vulnerable to third parties, while Republicans have spoken out against the rising foreign influence that is using the app to brainwash impressionable young Americans.

The case, which started this week in the U.S. Court of Appeals for the District of Columbia, will see TikTok claim in court that the ban is a violation of the First Amendment right to freedom of speech. The Chinese company will also claim that the requirements for the company’s divestiture and eventual sale of TikTok are not “viable” due to being on such short notice. On the other side, lawyers for the Department of Justice (DOJ) will argue that the question at the crux of the law is not about free speech, but about national security.

TikTok’s lawyers are also at a severe disadvantage in the case due to many of the DOJ’s filings being redacted and classified, thus preventing the company’s lawyers from knowing exactly what they are arguing against.

The case will not be decided until after the presidential election on November 5th. It is also expected that, whatever the appeals court decides, the eventual ruling will be appealed to the Supreme Court.

Vice President Kamala Harris (D-Calif.), the Democratic nominee, has not yet said whether she supports or opposes the bill that her superior signed into law. Former President Donald Trump, the Republican nominee, has said that he opposes the current bill. Both the Trump and Harris campaigns have active TikTok accounts, in an effort to appeal to younger voters.
