Biden Administration Extends “Temporary Protected Status” Into 2026 For Nearly 1 Million Immigrants

The Department of Homeland Security announced on Friday an 18-month extension of “Temporary Protected Status” for El Salvador.

“The Department of Homeland Security announced today the extension of Temporary Protected Status for El Salvador for 18 months, from March 10, 2025, to Sept. 9, 2026, due to environmental conditions in El Salvador that prevent individuals from safely returning. The corresponding Federal Register notice provides information about how to re-register for TPS under El Salvador’s TPS extension,” a press release from the Department of Homeland Security stated.

“The extension of TPS for El Salvador allows approximately 232,000 current beneficiaries to re-register for TPS, if they continue to meet eligibility requirements. Re-registration is limited to individuals who previously registered for and were granted TPS under El Salvador’s prior designation,” it added.

According to Axios, the Temporary Protected Status extension also applies to immigrants from Venezuela, Ukraine, and Sudan for 18 months.

The extensions protect immigrants before the start of the incoming administration, as President-elect Trump has promised hardline immigration policies and threatened ending TPS.

Trump tried to end TPS designations for several countries during his first term.

About 600,000 Venezuelan beneficiaries, who arrived in the U.S. on or before July 31, 2023, can reenroll to retain their status through Oct. 2, 2026.

The extension was “warranted based on the severe humanitarian emergency the country continues to face due to political and economic crises under the inhumane Maduro regime,” the Department of Homeland Security said in a news release.

About 1,900 Sudanese nationals can re-enroll on the basis of ongoing armed conflict and human rights abuses.

About 103,700 Ukrainian beneficiaries can re-enroll due to Russia’s war on Ukraine, which the DHS called a “humanitarian crisis.”

Friday’s move is notable since TPS is expected to be scaled back by the President-elect Donald Trump, who has vowed to dismantle Biden administration immigration policy, enact tougher immigration rules and launch a mass deportation campaign. TPS designations can be revoked by the DHS secretary, as long as the government provides a 60-day notice.

Trump and incoming Vice President JD Vance have both signaled their opposition to TPS, which Republican lawmakers and immigration hawks have long argued has been improperly extended, despite its temporary nature. During Trump’s first administration, the government tried to end TPS protections for hundreds of thousands of immigrants, though its efforts were stalled by legal challenges.

While it announced the TPS extensions, the Biden administration on Friday declined to make new arrivals eligible for the temporary status, despite calls from progressive activists who say the move would make it harder for Trump to carry out his promised mass deportations. Redesignating the TPS program for Venezuela, for example, would make an additional 450,000 migrants eligible for the initiative, according to internal government estimates obtained by CBS News.

The Biden administration has also faced pressure from advocates to allow hundreds of thousands of Nicaraguan immigrants to apply for TPS ahead of Trump’s inauguration. But officials are leaning against it, two people familiar with internal deliberations told CBS News, in part due to concerns about the move appearing like a politically motivated effort to hinder the incoming administration.
