Jack Smith has just filed new evidence in his January 6th case against President Trump.

The sealed evidence — 180 pages worth — was submitted to Judge Chutkan, who will make the call as to whether to release the files to the public, just 40 days out from the 2024 Election.

Special Counsel Jack Smith’s team filed a roughly 180-page brief on Thursday in his revised criminal prosecution against former President Donald Trump over the contest of the 2020 election results.

The contents of the massive legal filing were under sealed, but it is possible that some of it may be made public in the coming weeks, just before the Nov. 5 election.

Mr. Smith’s legal team was given the green light by U.S. District Judge Tanya Chutkan, an Obama appointee, earlier this week to file the oversized motion. The normal limit is 45 pages.

The federal government said it expected to use the extra pages to provide the court with “a detailed factual proffer” with attached exhibits following the Supreme Court’s ruling on presidential immunity this summer.

“For the court’s awareness, the opening brief and its exhibits contain a substantial amount of sensitive material, as defined by the protective order,” stated the feds’ filing earlier this week. It said the government intended to file under seal an unredacted copy of the motion and appendix, “and proposed redacted versions,” later on the public docket at the court’s direction.

As of the 5 p.m. filing deadline on Thursday, no public document was available on the docket.

Mr. Smith’s spokesperson Peter Carr confirmed that he met the deadline.

Mr. Trump’s team protested the oversized motion, saying that the government “aims to proffer their untested and biased views to the court and the public as if they are conclusive.”

A spokesperson for Smith’s office confirmed with the Associated Press on Thursday that the brief was filed before the 5 p.m. EST deadline set by U.S. District Judge Tanya Chutkan. The details of the brief are under seal and have not hit the public docket yet, although a redacted version is expected to be filed at a later time.

Smith’s office said in a filing over the weekend that the brief, which is expected to contain grand jury transcripts and multiple exhibits related to the investigation, would not exceed 180 pages. Trump’s defense team had argued on Monday that prosecutors should be blocked from filing the brief, given that its page count was significantly higher than what is typically accepted by Chutkan. The judge granted the special counsel’s office request to exceed the typical 45-page limit in a motion a day after Trump’s objections were filed.

Trump is facing four felony counts related to his alleged efforts to overturn his 2020 election loss to President Joe Biden, including the former president’s actions leading up to the riots at the U.S. Capitol building on January 6, 2021. Trump has pleaded not guilty to all charges and has sought to dismiss the case on several occasions, although all of such efforts have been denied.
